Welcome to joincherryclub.com (the “Site”), operated by Cherry Club (“Cherry Club”, “we”, “us”). These Terms of Use govern your access to and use of the Site, including joining the waitlist, reading published content, and playing the Cherry Catch game. By using the Site you agree to these terms. If you do not agree, do not use the Site.

Pre-launch status

Cherry Club is in a pre-launch phase. No products or memberships are currently for sale through the Site. Joining the waitlist places you on a list to be notified about future launches. Joining the waitlist does not create a doctor-patient relationship or any membership contract.

Account & waitlist data

You may submit your email, name, city, and optional story to join the waitlist. You agree the information you provide is accurate and that you are at least 18 years old. You may request deletion of your waitlist data at any time via Your Privacy Rights.

Intellectual property

The Cherry Club name, crest, monogram, manifesto text, photography, and the design of the Site are owned by Cherry Club or its licensors and are protected by US trademark and copyright law. You may not copy, reproduce, or use any Cherry Club mark or branded material without our written permission. To report misuse, see Brand Protection.

Acceptable use

• No scraping, harvesting, or automated collection of Site content.
• No interference with the Site, its security, or other users.
• No submission of unlawful, harassing, or infringing content.
• No reverse engineering of the Cherry Catch game to manipulate scores or rewards.

Disclaimers

The Site is provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, Cherry Club will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site.

Governing law & arbitration

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in the United States. You waive any right to participate in a class action.

Changes

We may update these Terms. Material changes will be reflected by the “Updated” date above. Continued use after a change means you accept the new terms.
